Privacy Policy
Maffra Web Design  respects the privacy of its Clients and will only request the minimum required information to deliver an effective  website.  Personal details are kept confidential and will not be shared or sold on to third parties. The Client’s email address will only be used to communicate with them in relation to their website.

Terms and Conditions
I am not responsible for the content of any website that I develop for Clients. The Client assumes all responsibility in relation to the intellectual property and copyright ownership of all material that is provided to me.  I reserve the right to refuse any content that I deem to be unsuitable for publication.

It is the Client’s responsibility:

  • to obtain all necessary permissions, authorizations, licenses and consents in relation to the use of Third Party Material which is incorporated into the website. This includes but is not limited to text, photographs, graphics, music and video
  • to ensure that the use of any Third Party Material incorporated into the website does not infringe the Intellectual Property Rights of any Third Party
  • to pay for all royalties or licence fees associated with the use of a Third Party’s Intellectual Property Rights in connection with any Third Party Material incorporated into the website
  • if a credit to a Third Party’s work is requested (with the exact wording and a link to their website if applicable), I must be informed so I can add this to the website
  • if people’s faces feature in photographs, it is the Client’s responsibility to seek permission that their images are published online and keep records of their agreement
  • if children’s faces feature in photographs, it is the Client’s responsibility to seek parental or guardian permission to use their image 

The copyright of content submitted to be displayed on their website is the client’s responsibility. Any legal costs arising from a dispute relating to any design material Maffra Web Design has created for the client, is the client’s responsibility.

I will assume that the Client has satisfied all of the above conditions.

 1.  Domain Name and Web Hosting
The client needs to register a domain name* and purchase web hosting.
If preferred, I can register the Domain Name and purchase the web hosting for the client. The total cost is around $100 p.a.
Please note these costs are in addition to my quote and need to be paid before I can commence to build the website.

*Domain name subject to availability & eligibility.
An ABN is required for all .au domains.

2.  Content
A standard web page consists of up to 300 words and up to 4 images.
Upon receipt of all content I will provide the Client with a quote which will be valid for 30 days.

3. Maintenance and Hourly Rate
Website maintenance is included for a 30 day period. Maffra Web Design  strives to accommodate the needs of each Client and maintains a liberal maintenance policy but if significant page modification is requested after a page has been built to the Client’s specifications, it will be billed at the hourly rate.

The 30 day maintenance period commences when the client is informed that the website is completed.

If the Client, or an agent other than Maffra Web Design, attempts updating the Client’s pages, time to repair any mistakes is not included as part of the 30 day maintenance period, and will be assessed at the hourly rate.

4. Completion Date
Maffra Web Design and the Client must work together to complete the website in a timely manner. Maffra Web Design agrees to work expeditiously to complete the website within 15 business days after having received all web content. However, Maffra Web Design will not be responsible for delays due to circumstances such as prior projects, illness, equipment failure, or other unforeseen situations. If the Client wishes to add extra content after Maffra Web Design has commenced to build the website the completion date will be pushed back and hourly rates will apply to adding the additional content. If the extra content is not submitted within a reasonable time Maffra Web Design will continue to complete the website and add the extra content at a later date and bill the Client accordingly.

Please remember these are general guidelines, I will make every effort to meet your deadline.

5. Fees
Fees to Maffra Web Design are due and payable on the following schedule:
  >  for projects under $500 full payment is required at the beginning.
  >  for projects over $500, a 50% deposit is required to commence the work, and the remaining balance will be due when the Client is informed that their website is live on the internet.
Final payment must be received within 14 days after notification that the website is live. Late payment may incur extra charges.

Once the client informs me that the deposit has been paid I will assume that all content has been supplied and I will commence to build the website.

Direct bank credit (EFT) is the preferred payment method.

Maffra Web Design is not registered for and does not charge GST.

6. Ongoing Support
If you have a simple question it will be usually be answered at no charge.

Maffra Web Design will provide the Client with  instructions on how to update the content on their website. If the Client does not have the time or is unsure of how to make changes to their website Maffra Web Design offers a website update service at an hourly rate of $60 (minimum charge $25). 

7. Indemnification
In no event will Maffra Web Design be liable to the Client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of the client’s web pages or website.

The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Maffra Web Design for inclusion in web pages are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Maffra Web Design from any claim or suit arising from the use of such elements furnished by the Client.

8. Copyright to Web Pages
Upon final payment the Client is assigned the rights to the website design, graphics and text in the finished assembled website. Rights to photos, video, audio, graphics and source code are specifically not transferred to the Client, and remain the property of their respective owners. Maffra Web Design retains the right to display graphics and other web design elements as examples of its work in its respective portfolios.

Should Maffra Web Design cease business the client retains the right to continue using the website.

A small Maffra Web Design credit link will be placed at the bottom of each page. This link must not be removed.

9. Google
It generally takes about a month or two for a new site to be fully shown in search results after the website goes live.

The Client understands that search engine rankings are not permanent. Search engines can change the algorithms that they use to display results. Competitors who are also doing SEO on the same keyword(s) can change your ranking to become lower or higher, and if this occurs, it is not a reflection of poor work by Maffra Web Design but simply the way search engines work.

If you want to be guaranteed a top ranking on the Google directories a good option is to utilise Google Adwords and set up several key ads that run on the right hand side of the Google search results pages. You can set a monthly budget for these with a minimum $ amount and you only pay when someone clicks to your site. It’s not free but it is a much cheaper option than what you could pay if you sign with someone promising to get you to the top of the Google list.

Using Social Media to search out business websites has become more common recently with the increased growth of Facebook, Twitter, LinkedIn, Pinterest, Tumblr, Instagram etc. Having one or more of these pages set up for your business and linked back to your website can help your search engine ranking due to the amount of web traffic they generate.
